Terms and Conditions

Paying the Trek / Adventure Activity Fee :
When you book any Trek services from Himalayasgriffon, you enter into a contract with us (‘First Party’) and you (‘Second Party’). This agreement also applies to anyone you book services for. By booking with Himalayasgriffon, you agree to these terms and conditions.
Trekking, climbing, and mountaineering in the Himalayas come with risks to both life and property. Weather can change suddenly, which can cause injury or death, and this is beyond our control. We do our best to minimize risks, discomforts, and hazards within our abilities, but accidents, mishaps, or service issues may still happen. By booking with us, you accept these terms. Please read and understand them before confirming your booking.

Promotions:
The images displayed on our website and promotional materials are intended solely for marketing purposes. They are representative and do not guarantee that the specific visuals depicted will be part of your travel experience. These images should not be interpreted as an assurance that you will encounter or witness the exact scenery, locations, or activities shown.

Fitness Responsibility
Himalayasgriffon offers trips and treks that require varying levels of physical fitness, which depend on factors such as physical exertion, terrain, weather, and climate conditions. Some trips may be physically demanding. It is your responsibility to thoroughly review the difficulty level of each trip before booking to ensure it aligns with your capabilities and allows you to prepare adequately.
Himalayasgriffon is not a medical authority, and it is your duty to seek appropriate medical advice and comply with the latest health requirements, including vaccinations, before joining a trip. We are not responsible for any inability to cope with the demands of a trek. Although many treks do not require special preparation, a reasonable level of fitness will enhance your experience. You are solely responsible for ensuring that you are physically and mentally prepared for the trip, and for bringing the proper clothing and equipment.
While there is no specific age limit for participation, any physical or medical condition, disability, pregnancy, or mental health issue that may impact your ability to complete the trek must be disclosed at the time of booking. You also confirm that you and any companions for whom you are booking do not suffer from any condition that could pose a risk to your safety or the safety of others during the trip.
Failure to disclose such information may result in the immediate termination of your participation, with applicable cancellation penalties. Himalayasgriffon reserves the right to decline, accept, or remove any participant from a trip at their own expense if their condition poses a risk to themselves or other participants.

Program Dates:
You are solely responsible for reviewing and confirming the accuracy of all dates specified on your travel documents. Please verify these details carefully to avoid any discrepancies.

Documents:
All required documents must be submitted in advance. Himalayasgriffon is not responsible for any delays or disruptions caused by incomplete trip formalities or missing essential documents prior to departure.

Itinerary:
Your safety and enjoyment are top priorities for Himalayasgriffon. We are committed to fulfilling our responsibilities with honesty and diligence to ensure a seamless and enjoyable experience.
However, Himalayasgriffon reserves the right to modify or cancel any part of the itinerary due to unforeseen circumstances, including but not limited to natural disasters, road closures, political unrest, flight cancellations, delays, illness, accidents, or other events beyond our control. Any additional costs incurred due to such changes will be your responsibility and must be settled on the spot. Wherever feasible, we will notify you of any changes in advance or during the trip.

Refund Policy:
No partial or full refunds will be provided if you voluntarily leave or withdraw from a trip for any reason after it has commenced. Refunds will not be issued for any unused accommodations, transportation, sightseeing, meals, or services.
In the event that Himalayasgriffon cancels a trip due to unforeseen circumstances, we will offer an alternative trip or date. You will be notified of this change, and you may choose to accept the alternative trip, receive a voucher valid for one year, or select another trip of your choice. Any cost differences will be your responsibility. Himalayasgriffon will not be liable for additional fees, credit card charges, commissions, or other travel arrangements, including but not limited to flight cancellations, railways, hotels, visa costs, or onward travel plans. Refunds, in this case, will follow our cancellation policy.
Refunds are not available for missed or unused services, including situations such as voluntary/involuntary tour termination due to illness, family emergencies, late arrival, or other personal reasons.
Himalayasgriffon will not be liable for compensation resulting from trip curtailment, alteration, extension, or cancellation for any reason. However, you expressly agree that, under any circumstances, the maximum liability of Himalayasgriffon will be limited to the amount paid for the trip.

Communication:
All communications will be conducted through the WhatsApp / call & mail address provided by the participant in the registration form. Himalayasgriffon is not responsible for any loss or delay in communication.

Luggage Responsibility:
Baggage and personal effects are your sole responsibility throughout the trip. You are fully accountable for your personal belongings while traveling. Himalayasgriffon is not liable for any loss of baggage, goods, air tickets, passports, cash, traveler’s cheques, or any other personal items or documents during the trip, regardless of the cause.

On-Trip Behavior:
You are expected to conduct yourself in a manner that is respectful and conducive to group travel. Himalayasgriffon reserves the right to terminate your trip if you cause distress or annoyance to fellow travelers or if you endanger or damage the property of suppliers or other participants. In such cases, no refund will be provided for unused services.
You also agree to adhere to the authority of the group leader designated by Himalayasgriffon. The decisions made by the tour leader regarding the safety and well-being of participants are binding on all members of the group. Behavior that poses a danger, causes distress or annoyance to others, or interferes with the group’s mobility may result in the termination of your participation in the trip, with no right to a refund for missed or unused services.

Amenities:
Himalayasgriffon strives to ensure the comfort of our guests; however, please understand that the amenities available in the Himalayan region may differ from those you are accustomed to at home. Additionally, weather conditions can significantly affect your journey. We encourage you to approach this adventure with patience, enthusiasm, and a willingness to make compromises.

Extra Expenses
Inclusions for each trip vary, encompassing accommodations, meals, arrival and departure transfers, guides, entrance fees, equipment, and baggage handling as specified in the itinerary.
Unless otherwise indicated, the following costs are not included: insurance, international and domestic airfare, passport and visa fees, departure taxes, excess baggage charges, gratuities for guides, drivers, and camping staff, meals not mentioned in the itinerary, beverages, and personal expenses such as laundry, phone calls, and optional tours

Awareness:
You acknowledge that the very nature of active and adventure travel involves a certain level of personal risk. You may visit areas where political, cultural, and geographical factors present inherent risks, dangers, and physical challenges. By booking a tour with Himalayasgriffon, you confirm your awareness of these personal risks, dangers, and challenges associated with such travel and willingly assume all associated risks. You release Himalayasgriffon from any claims or causes of action arising from damages, injuries, or death resulting from these inherent risks. It is your responsibility to familiarize yourself with the customs, weather conditions, physical challenges, and applicable laws in each destination, as well as to have the contact information for your local embassy.

In Case of Emergency:
Should you fall ill or sustain an injury during the trip, you will be solely responsible for all related expenses, including hospital bills, doctor fees, repatriation costs, evacuation from the road or mountain, and any other charges incurred directly or indirectly as a result of your illness or injury.

Third Party Services:
You understand that to effectively manage such a comprehensive operation, Himalayasgriffon engages the services of third parties who are professionals in their respective fields. You agree to absolve Himalayasgriffon from any liabilities, vicarious or otherwise, arising from deficiencies in the services provided by these third parties. Himalayasgriffon will not be responsible for any harm, loss, or damage to your luggage, belongings, or person when carried by porters, ponies, or vehicles during the trip, as well as during your arrival, departure, or stay at any hotel or guest house.

Photography Rights:
Himalayasgriffon reserves the right to take photographs of you during any trip and to use any photos shared by you via email, WhatsApp, or any website link for promotional purposes. By booking or participating in a trip with us, you automatically grant us a royalty-free, perpetual, worldwide, and irrevocable license to use your images in photographs and videos for promotional materials, websites, social media, collateral, and other marketing and publicity materials. Himalayasgriffon does not require your prior consent nor will it compensate you for the use of your photographs or videos. However, we do cater to media professionals. If you have any concerns regarding the use of your images, please inform us at the time of booking your trip.

Optional Activities:
Optional activities do not form part of the trip or this contract. You agree that any assistance provided by Himalayasgriffon, its partners, or representatives does not render Himalayasgriffon liable in any way. Your contract for such activities will be directly with the activity provider, and you hereby release Himalayasgriffon from all claims and causes of action arising from your participation in these activities.
Himalayasgriffon acts solely as a travel organizer. We do not control or operate any airline, hotel, restaurant, tourist attraction, transport, or any other facility or service mentioned in our itineraries.
We have taken all reasonable steps to ensure that trip preparations meet the required standards. We carefully select our service providers and strive to ensure that service descriptions are accurate. However, Himalayasgriffon can only select and inspect these providers and has no control over their management or operations. Therefore, we cannot be held liable for any injury, damage, loss, accident, delay, or irregularity that may arise (directly or indirectly) from the acts or deficiencies of suppliers engaged in delivering specific services. The terms and conditions of suppliers, where applicable, are expressly indicated when they apply.
By visiting and browsing this official website of Himalayasgriffon, you legally accept and agree to comply with the company’s Terms and Conditions, which, along with the privacy policy, govern your relationship with the company and the website.

Definitions
Himalayasgriffon,” “us,” or “we” refers to the company and its directors.
You” refers to the viewer or user of the website.
• Himalayasgriffon reserves the right to modify or change any terms applicable to the trip without prior notice or reason.
• We reserve the right to discontinue any trip without prior notice or reason.
• Himalayasgriffon may, at any time and without prior notice, add, alter, or modify any of these terms and conditions or replace, in whole or in part, any trip or withdraw it altogether.
• In the event of any disputes, the decision of Himalayasgriffon will be final and binding on both parties. Arbitration and litigation are your constitutional rights and shall be exercised in accordance with Indian law.

Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of India. Both Himalayasgriffon and you irrevocably consent to the exclusive jurisdiction of the courts of India to resolve any disputes arising in connection with these Terms.

Dispute Resolution
In the event of any issues or challenges during your Trek with us, please notify the relevant personnel immediately while on the trek. You should inform your Trek Leaders or directly contact our Operations Team , This will allow us to address your concerns promptly and strive to resolve any issues as quickly as possible.
The company shall not be held responsible for the non-performance of an itinerary due to circumstances beyond its control, or if we are not informed of a problem at a stage where remedial action can be taken. In the unlikely event that a complaint cannot be resolved during your trip,
Any disputes arising from this agreement shall be governed by Indian law, and both parties agree to submit to the jurisdiction of the Uttarakhand court in Dehradun
